Welcome to [Yjed Information Technology Company]. These Terms and Conditions govern your use of the live pet tracking service (hereinafter referred to as "Yjed" or "the Service"), which includes the smart tracking device (an IoT-based device), the mobile application, the website, and the backend infrastructure. By using the Service, you agree to these Terms and Conditions.
1. Key Definitions
The Company: [Yjed Information Technology Company / Commercial Registration No. 4030505159], based in Jeddah, Kingdom of Saudi Arabia.
The Client/User: The person or entity who has purchased or is using the Service.
The Service: The real-time pet tracking system, which includes the tracking device, the mobile application, and the subscription to the tracking platform.
Tracking Device (IoT Device): The location device equipped with IoT technology and provided by the Company.
Location Data: Real-time and historical geographical data collected by the Tracking Device and transmitted to the application.
2. Service Scope and Geographic Limitations
Geographic Scope: The Service is provided only within the borders of the Kingdom of Saudi Arabia.
The Company does not guarantee the quality or availability of the Service outside this scope, and the Device may not function correctly.
Service Provision: The Service is subject to the availability of cellular coverage and the satellite network (GPS) at the pet's location.
The Company is not responsible for tracking interruptions or inaccuracies resulting from weak or non-existent cellular coverage or signal obstructions.
Network Subscription: The Tracking Device requires a cellular data network subscription (SIM Card).
The Client is responsible for paying the fees for this subscription, unless the subscription is explicitly part of a Service package provided by the Company.
3. Client Obligations
Pet Safety: The Client acknowledges and agrees that the Tracking Device is not a substitute for direct supervision and care of the pet.
The Company assumes no responsibility for the pet's safety or any accidents or injuries it may sustain.
Device Maintenance: The Client is responsible for:
Charging the Device regularly and ensuring its functionality.
Securing the Device safely and comfortably on the pet.
Protecting the Device from unusual damage or submersion in water (unless otherwise stated by a water resistance warranty).
Information Accuracy: The Client must keep their contact information updated and accurate within the application.
4. Intellectual Property and Data
Data Ownership: The Client acknowledges that the Location Data and Service usage data collected by the Tracking Device belong to the Company.
Data Usage: The Company has the right to use the collected Location Data for the following purposes:
Providing the Service and displaying the data to the Client.
Improving the Service quality, developing products, and conducting anonymized statistical analyses.
User personal data is handled in accordance with the Company's Privacy Policy.
5. Limitation of Liability and Warranty
Device Disclaimer: The Tracking Device is provided "as is".
The Company's liability regarding the Device is limited to the Product Limited Warranty, which covers manufacturing defects only for a period of [2 years only] from the date of purchase.
Exclusion of Liability for Losses: Under no circumstances shall the Company be held liable for any indirect, incidental, or punitive losses or damages, including:
Loss, injury, or death of the pet.
Any damage arising from delay or inaccuracy in transmitting Location Data.
Any damages resulting from the failure of the Internet or cellular communication network.
Maximum Liability: In the event of any proven legal liability on the Company, the Client agrees that the maximum financial liability of the Company towards them shall not exceed the value the Client paid for the Tracking Device and the last annual Service subscription.
6. Service and Price Modification
The Company reserves the right to modify or discontinue any part of the Service (including the application and technical functionalities) at any time with reasonable prior notice for purposes of updating, maintenance, or development.
7. Governing Law and Dispute Resolution
Governing Law: These Terms and Conditions shall be governed by and interpreted in accordance with the laws and regulations in force in the Kingdom of Saudi Arabia.
Dispute Resolution: In the event of any dispute, both parties agree to first exert efforts for an amicable resolution.
If a resolution is not reached, the courts of the City of Jeddah shall be the competent authority to consider the dispute.
